  1. Acceptance of Terms

  3. User Registration

Your account is non-transferable and for your sole use. You are fully responsible for all activities under your account and must safeguard your credentials. Promptly notify us of any unauthorized access or use.

    You acknowledge that we make no representations or warranties regarding user or third-party conduct. While we endeavor to maintain accurate listings and real-time inventory, availability is never guaranteed. We disclaim any liability for inaccuracies, omissions, or unavailable items.
  5. Purchases and Payments
    Offers to purchase may be made via the Site’s secure checkout or by direct communication with JaneFinds. You agree to furnish valid payment information and authorize all charges. Certain transactions may require bank-wire payment; we will notify you in advance. The total purchase price includes item cost, shipping fees, and applicable taxes. By submitting payment, you affirm your obligation to fulfill these terms.
  6. Sales Confirmation and Cancellation Policy
    Upon issuance of a Confirmation of Sale, the transaction is final and irrevocable unless otherwise agreed in writing prior to sale. Chargebacks are strictly prohibited. You remain fully liable for any fees or costs arising from unauthorized or fraudulent chargebacks. Initiating such chargebacks—commonly known as “friendly fraud”—exposes you to civil litigation and potential criminal prosecution.
  7. Promotional Offers
    We may, at our sole discretion, offer promotions or discounts. Any promotional terms, conditions, or durations may be amended or withdrawn at any time without notice, except where prohibited by applicable law.
  8. Credit Card Authorization
    By providing credit-card information, you authorize us to charge your card for all purchases and related fees. In the event of payment default or reversal, you remain liable for the full purchase amount plus all collection, legal, and administrative costs.
  9. Tax Responsibility
    You are responsible for any and all taxes, duties, or customs fees arising from your purchase. We will collect sales tax where required by law for transactions conducted within the United States.
  10. Item Condition and Sales
    All items are sold “as is,” with no warranties beyond the description provided on the Site. We guarantee authenticity but make no other express or implied warranties regarding condition, merchantability, or fitness for a particular purpose.

  14. Indemnification
    You agree to indemnify, defend, and hold harmless JaneFinds and its affiliates, officers, directors, and employees from any third-party claims, liabilities, damages, or expenses (including reasonable attorneys’ fees) arising from your use of the Site or any breach of these Terms.
  15. Risk of Loss
    Risk of loss and title to purchased items pass to you upon our delivery of the items to the carrier.
  16. Site Availability
    We reserve the unilateral right to modify, suspend, or discontinue the Site or any part thereof at any time, with or without notice. We will not be liable to you or any third party for any suspension or discontinuation.
  17. Disclaimers
    THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
  18. Limitation of Liability
    IN NO EVENT SHALL JANEFINDS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, OR FOR ANY AMOUNT EXCEEDING THE GREATER OF (A) THE TOTAL FEES YOU PAID FOR THE SPECIFIC TRANSACTION, OR (B) USD 100.
  19. Termination of Use
    We may terminate or suspend your access to the Site immediately, without prior notice or liability, for any breach of these Terms. Sections 4, 6, 10–14, 17–19, and 21–24 shall survive termination.
  20. Governing Law and Dispute Resolution
    These Terms are governed by and construed in accordance with the laws of the State of New Jersey, without regard to conflict-of-law principles. Any dispute shall be resolved exclusively by binding arbitration in Newark, New Jersey, under the rules of the American Arbitration Association.
  21. General Provisions
    These Terms, together with our Privacy Policy, constitute the entire agreement between you and JaneFinds regarding the Site. If any provision is held invalid or unenforceable, the remaining provisions shall remain in full force. Our failure to enforce any right or provision will not constitute a waiver.
  22. Shipping Policy
    We employ FedEx Direct Signature Required or UPS Overnight Signature for domestic U.S. shipments at no additional charge, except for exceptionally high-value items. For international deliveries, we use FedEx International Priority or DHL Select, shipping to over 60 countries. We cannot deliver to P.O. Boxes, APO/FPO addresses, or certain U.S. Territories.
  23. Payment and Shipping Policies
  • Matching Billing Information: For security, the billing details you provide must exactly match the credit or debit card used for payment. Any discrepancy will result in order cancellation without notice.
  • Shipping Timeline: Once your order is accepted and inventory is confirmed, we will dispatch your items within two (2) business days. For expedited or last-minute orders, contact us in advance to confirm availability and timelines.
  • Payment Limits: Credit-card transactions are limited to USD 50,000.00 per order. Purchases beyond this amount must be paid by wire transfer. Holds above the limit will be released and the order canceled.
  • Shipping Address: Shipments will only be sent to the billing address verified against your payment method. Delivery addresses cannot be modified once an item is shipped.
  • Refund Policy: All credit- or debit-card processing fees are non-refundable. Any refund issued will be net of these non-recoverable charges.
  • Chargebacks: Chargebacks are strictly prohibited. You remain fully liable for any fees or costs arising from unauthorized or fraudulent chargebacks. Initiating “friendly fraud” may expose you to civil litigation and criminal prosecution.
  • Sanctioned Countries: In compliance with U.S. export controls and economic sanctions, we do not accept orders or payments from sanctioned jurisdictions.
  • Cryptocurrency Payments: We welcome settlements in Ether (ETH) and Bitcoin (BTC). Contact us directly for payment instructions and wallet details.
  • Fee-Shifting
    In any dispute, claim, or proceeding arising out of or relating to these Terms, the prevailing party (whether by settlement, arbitration award, or court judgment) shall be entitled to recover its reasonable attorneys’ fees, costs, and expenses, including any on appeal.
